Section 1: Overview

Xyken, LLC d/b/a SnugFit Solutions ("Xyken," "we," "our," or "us") develops and provides mobile applications, hosted cloud platforms, software development kits (SDKs), APIs, artificial intelligence (AI), computer vision technologies, and 2D and 3D imaging solutions for consumers, healthcare providers, manufacturers, laboratories, retailers, industrial users, and other commercial customers (collectively, the "Services").

This Privacy Policy explains how we collect, use, disclose, retain, and safeguard information when you use our Services. By accessing or using the Services, you acknowledge this Privacy policy.

Section 2: 3D Scanning Solution with TrueDepth Camera Sensor

- What information does our scanning application (or app) collect using the TrueDepth API?

During capturing, the app collects the front-facing TrueDepth camera’s depth and RGB information of each frame using TrueDepth API. The app also collects the metadata of the TrueDepth camera including TrueDepth camera’s intrinsic matrix and distortion map.

- For what purposes does the app collect this information?

The application uses this information altogether to perform the depth fusion process and generate the colored 3D mesh of the scanning object. The user can view and share the generated 3D mesh file as one wishes.

- Will the data be shared with any third parties?

The data is only used for generating the final 3D mesh and the app does not send it to any third parties.

-  Where will this information be stored?

During the depth fusion process, the app stores the collected data (depth, RGB images, camera metadata) in a temporary folder in the documents folder of the app. All the data in the temporary folder will be overwritten during the next scanning. It will also be removed automatically when the user uninstalls the app or logout. The user has the option to store or share the data. The app may offer the option to upload the data to a secure server where it can be deleted upon request.

- What's the policy for collection, use, disclosure, sharing, and retention of face data?

Though our 3D scanner application is not designed for capturing 3D face data, it may be used to capture face data. We do not recommend using the scanning app to capture face data because these data are sensitive. In the event face data are captured, if the data is stored on our cloud server, we will not use, disclosure, or share any face data to a third party. We reserve the right to remove the face data at any time.

Section 3: Front and Rear Camera-Based 3D Scanning

Certain Services use standard front-facing and/or rear-facing cameras on supported Apple and Android devices to generate 3D scan data. Depending on the Service, 2D images captured by the camera may be securely transmitted to Xyken's processing servers solely to reconstruct 3D scan data and provide the requested functionality.
 

Unless otherwise agreed, uploaded 2D images are automatically deleted from Xyken's processing servers within approximately five (5) days after processing. Reconstructed 3D scan data may be retained as necessary to provide the Services, support customer workflows, or as described in applicable agreements or this Privacy Policy.

Section 4: Information We Collect

We may collect: (a) account information such as name, company, email address, telephone number, billing information and account credentials; (b) Client or User Data, including orders, images, videos, 3D scans, measurements, files and other content submitted through the Services; (c) technical and usage information such as device identifiers, operating system, authentication logs, diagnostics, crash reports and application usage; and (d) subscription and billing information.

Section 5: How We Use Information

We use information to provide, operate, maintain, secure, improve, and support the Services; authenticate users; process scan data; provide customer support; administer subscriptions; comply with legal obligations; conduct research, software testing, quality assurance, benchmarking, product development, algorithm improvement, and AI and machine learning development. Where reasonably practicable, research and development activities use de-identified or aggregated information.

Section 6: Business and Consumer Users

Some Services are provided directly to consumers, while others are provided on behalf of manufacturers, laboratories, retailers, healthcare providers, or other business customers. Depending on the Service used, Xyken may collect information directly from you or process information on behalf of a business customer. Business customers are responsible for determining the purposes for collecting personal information and obtaining any notices or consents required by applicable law.

Section 7: Sharing Information

We do not sell personal information. We may disclose information to trusted service providers, business partners acting on your instructions, governmental authorities when required by law, or in connection with mergers, acquisitions, financing transactions, or sales of assets.

Section 8: Data Retention

We retain information only as long as reasonably necessary to provide the Services, comply with legal obligations, resolve disputes, enforce agreements, support research and product improvement as permitted by law, or as otherwise described in applicable agreements.

 

Section 9: Security

We maintain commercially reasonable administrative, technical, and physical safeguards designed to protect personal information and other data from unauthorized access, use, alteration, or disclosure. No security measure can guarantee absolute security.

 

Section 10: Children's Privacy

Our Services are not directed to children under 13 years of age, and we do not knowingly collect personal information from children under 13.

 

Section 11: International Data Transfers

If you access the Services outside the United States, your information may be transferred to and processed in the United States or other jurisdictions where Xyken or its service providers operate, subject to applicable legal safeguards.

 

Section 12: Changes to this Privacy Policy

We may update this Privacy Policy from time to time. The revised version will be posted on our website with an updated effective date.
